Cenzon-DeCarlo case dismissed

Cathy Cenzon-DeCarlo, a pro-life nurse at Mount Sinai Hospital, was threatened with disciplinary measures if she didn’t participate in an abortion. After the abortion, Cenzon-DeCarlo filed suit on the grounds that the hospital had violated the Church Amendment, which protects doctors and nurses from being forced to participate in abortions. In a decision yesterday, a federal court of appeals dismissed the suit on the grounds that the federal law does not allow private parties to sue to enforce the law.

Cenzon-DeCarlo still has a state case pending.
