Here is a link to a story by Ed Whelan on the August 16, 2023 decision by the Fifth Circuit. The appellate court upheld important parts of the trial court’s order that found that the FDA’s approval of mifepristone was unlawful.
The lower court’s ruling is, however, on hold pending Supreme Court review.
